सुप्रीम कोर्ट के सात जजों की संविधान पीठ ने अलीगढ़ मुस्लिम विश्वविद्यालय (AMU) के अल्पसंख्यक संस्थान के दर्जे पर चर्चा शुरू की है। विश्वविद्यालय के वकील राजीव धवन ने दावा किया कि AMU शुरुआत से ही अल्पसंख्यक संस्थान था, और इलाहाबाद हाईकोर्ट का 5 जनवरी 2006 का फैसला AMU को अल्पसंख्यक संस्थान नहीं मानने के संदर्भ में सही नहीं है।
सीजेआई डीवाई चंद्रचूड़ की अगुवाई वाली सात-न्यायाधीशों की पीठ के समक्ष सुनवाई में एक महत्वपूर्ण निर्णय शामिल है कि क्या संसदीय कानून द्वारा स्थापित एक शैक्षणिक संस्थान संविधान के अनुच्छेद 30 के तहत अल्पसंख्यक स्थिति का दावा कर सकता है।
जस्टिस संजीव खन्ना, सूर्यकांत, जेबी पारदीवाला, दीपांकर दत्ता, मनोज मिश्रा और केवी विश्वनाथन सहित पीठ इस प्रश्न का समाधान करने के लिए तैयार है। इससे पहले, न्यायमूर्ति संजय किशन कौल पीठ का हिस्सा थे लेकिन 25 दिसंबर, 2023 को सेवानिवृत्त हो गए।
मामला 2005 का है जब अलीगढ़ मुस्लिम विश्वविद्यालय (एएमयू) ने अल्पसंख्यक संस्थान के रूप में अपनी स्थिति का हवाला देते हुए मुस्लिम उम्मीदवारों के लिए स्नातकोत्तर चिकित्सा पाठ्यक्रमों में 50% सीटें आरक्षित की थीं। इस फैसले को इलाहाबाद हाई कोर्ट ने पलट दिया था. 2006 में, केंद्र सरकार और एएमयू दोनों ने सुप्रीम कोर्ट के समक्ष इस फैसले को चुनौती दी।
2016 में, राष्ट्रीय जनतांत्रिक गठबंधन सरकार ने विश्वविद्यालय की अल्पसंख्यक स्थिति को मान्यता देने से इनकार करते हुए अपील वापस ले ली। वर्तमान सुनवाई संसदीय क़ानूनों द्वारा शासित शैक्षणिक संस्थानों में अल्पसंख्यक दर्जे की मान्यता के लिए महत्वपूर्ण निहितार्थ रखती है।
